改革现行土地征收制度的法律思考——以保护农民利益为视角

我国现行的土地征收制度存在着诸多的缺陷,不利于在当前形势下保护被征地农民利益,已成为社会主义新农村建设和和谐社会建设的制约性瓶颈。改革现行土地征收制度,必须明确“公共利益”标准,严格控制土地征收范围;制定出科学、合理的征地补偿标准;界定明晰土地产权;增加征地透明度,赋予被征地农民知情权、参与权和起诉权;建立健全失地农民社会保障制度。

Legal Thoughts on Reforming Present System of Land Levy

There are a lot of flaws in our country's present system of land levy,which is not beneficial for protecting the benefits of the farmers whose land levied under current situation,and it has become an obstacle for the construction of new socialist countryside and harmonious society.Reforming present system of land levy demands the firm establishment of the standard of public benefits and strict limiting the scope of land levy,making out scientific, reasonable compensation standard for land levy,clearly defining the property rights of land,increasing the transparency of land levy to make farmers whose land levied enjoy the right of knowing,participating and litigating,establishing and perfecting the social security system for landless farmers.
