Legislative Interpretation of Compensation for Divorce Damage Caused by Other Major Fault

Article 46 of the Marriage Law strictly limits the fault situation of divorce damage compensation,which leads to confusion in the judicial judgment caused by insufficient legal reasons,unclear nature of divorce damage compensation,and insufficient rights relief.The nature of compensation for divorce damages in our country is the liability for breach of contract by the violation of the marriage contract by one of the spouses.When interpreting other major faults added in Article 1091 of the Civil Code:Marriage and Family,it is necessary to give full play to the system function of divorce damage compensation,and to balance the relationship between fault liability and freedom of divorce,and strive to achieve essential gender equality,fairness and justice.Divorce should be attributed to other major faults if a spouse's fault seriously violates the marital duty of loyalty,such as giving birth to a child by somebody else.The new principle of“taking care of the rights and interests of no-fault party”in Article 1087 of the Civil Code is different from Article 1091 in terms of system function and focus,and does not conflict in judicial application.
