新《监狱法》贯彻实施背景下改进和规范减刑工作的思考

减刑是我国刑罚执行机关在罪犯改造中最重要、最常用的一项激励措施，它在稳定监管秩序、促进罪犯改造等方面起着不可替代的重要作用。当前我国的减刑制度还存在着明显不足，实践操作中存在的罪犯奖惩标准不统一、不规范，罪犯减刑过快等问题比较突出。新《刑事诉讼法》、新《监狱法》相继出台，对减刑提出了更为严格的限制和要求。新形势下，亟须按照新《刑事诉讼法》和新《监狱法》的要求对减刑工作中存在的上述问题进行改进和规范。

Improving and Formalizing Commutation under the Implementation of New Prison Law

Commutation is the most important and most practical incentive in criminal reformation practice in penalty enforcement institutions. It plays an irreplaceable role in stabilizing supervision order and reforming criminals. The current commutation system in China is imperfect. In practice, it lacks unified and standard rewarding criteria; some commutations are too fast. The new Criminal Procedure Law and the new Prison Law have successively been issued, imposing stricter limitations and requirements for commutation. Under the new circumstances, it is imperative to correct and standardize commutation in accordance with the new laws.
