侦查讯问中若干矛盾之探析

讯问犯罪嫌疑人是我国刑事诉讼法规定的几种侦查取证行为之一，在侦查实践中也基本成为每个刑事案件的必经阶段。侦查讯问有可能成为案件侦破的有效措施，彰显法律的正义和建塑警察的良好形象；也可能由于侦查讯问中的非法讯问导致冤假错案，损害法律的权威和败坏警察的形象。侦查讯问是一个蕴含丰富内容的研究课题，而这种“丰富内容”就源自侦查讯问中存在诸多矛盾。厘清其中矛盾及其背后的原因，是侦查讯问理论及实务研究的逻辑起点和必由路径。

A Probe into Contradiction in Investigative Interrogation

Interrogating a criminal suspect belongs to investigative behaviors of collecting evidence provided by the criminal procedure law of our country, and is also the inevitable stage in investigation practice of every criminal case. It is an effective measure to detect a case, can highlight the law of justice, and build a good image of the police; however, if the interrogation is illegal, it may also cause unjust case, and will damage the image of the authority of law and police. Investigative interrogation contains the rich research as well as many contradictions. To clarify the contradictions and the reasons behind, is the starting point and the inevitable path of the research on the theory and practice of interrogation.
