| 摘 要： | 《最高人民法院关于审理商品房买卖合同纠纷案件适用法律若干问题的解释》出台以后,对现行的有关法律法规确实起到了拾遗补缺的作用,加强了对购房者的保护力度,同时也兼顾了房开商的利益,给司法实践中处理这类纠纷带来了极大的方便。但该解释仍有一些问题使人疑惑,产生了分歧,不利于对该解释的正确实施。

| Abstract: | The"Judicial Interpretation of Some Problems in the Law Application of Trying the Contract Disputes of Commercial Housing Sale"promulgated by the Supreme Court makes supplementary explanations of relevant laws and regulations,strengthening the protection for housing purchasers as well as giving considerations to the interest of real estate businessmen,therefore to bring much convenience to the settlement of this kind of disputes in legal practice.However,some puzzling problems in this interpretation are likely to bring about controversies and influence its correct enforcement in the practice. |
