法的合法性与整全性的关联分析

The Analysis of the Relevance of Integrity of Law to Legality of Law

The controversy over legal capacity has lasted as a predicament in jurisprudence of common law.Different schools offered different answers to this question.The paper starts from analysis of different modes for evaluating legality of law and proposes integrity of law is not only one mode but rather the best option currently to evaluate legality of law.The integrity of law theoretically coincides with the ultimate aim of law,namely,the highest command—the "kind" life of human being.It also helps accomplish equality,respect and the universal humanism solicitude in legal practice.Such law is proposed to be the ideal law.If this conclusion can be justified,the debate between Hart and Dworkin on the concept of law can be settled down,as well as the controversy over legal capacity from different schools.In respond to the predicament of legal capacity,it is suggested to analyze the relevance of integrity of law to legality of law and so as to introduce a new platform for theoretical restatement of jurisprudence of law.
