对我国居住权制度有关问题的思考

居住权制度在我国的发展并不完善,在《物权法》中缺失的主要原因可归结为社会与法律两个方面。实践中,应当将居住权在婚姻家庭法中的发展作为突破口,通过“物权法＋有关单行法”的多元立法体例。在我国的民法典体系内最终应当正式建立一个以物权法为核心、相关特别法为补充的全面现代的居住权制度。恢复其独立物权种类的法律地位。
