结果加重犯的构成结构分析

结果加重犯的成立,在客观结构方面,必须具备类型地有导致加重结果发生的高度危险性的基本犯罪行为(实行行为),并产生超过基本犯罪构成的法定加重结果;在罪过结构方面,基本犯只能是故意犯,对加重结果只能持过失;对因果关系的认定,应当考察基本行为与加重结果之间是否存在高度的危险关联以及基本行为对加重结果的发生是否起到实质的、决定性的作用;就加重处罚的根据,危险性说更为合理.
