| 摘 要： | 审前羁押制度和人权保障紧密联系在一起。我国审前羁押制度与过去相比已经有所改善,尤其是近年来,无论是理论界还是实务界都给予了极大的关注。但审前羁押中确实还存在不少问题。本文拟从人权保障的角度审视我国现行法律规定下的审前羁押制度,分析审前羁押在人权保障方面存在的问题并提出了完善的建议。

| Abstract: | There is a close relationship between the detention before trial and the protection of human rights. Different from the past, the present institution of detention before trial has been improved a lot, especially in recent year; much attention both in theoretical circles and actual affairs has been given. However, there are some problems in the detentions before trial. The author surveys China's present institution of detention before trial, analyzes the problems related to human right and puts forward some proper proposals. |
