| 摘 要： | 共同犯罪的成立特征与共同犯罪的犯罪构成是两个不同的概念。共同犯罪的成立特征是共同犯罪区别于单独犯罪的特殊性,而共同犯罪的犯罪构成与单独犯罪的犯罪构成则是相同的。而且,共同犯罪中各共同犯罪人成立犯罪所具备的犯罪构成也是相同的。

| Abstract: | The foundational character of common crime and the crime constitution of common crime are two distinctive concepts. The foundational character of common crime is the place distinguishing the common crime from the single crime. And yet, the crime constitution of common crime is identical with that of single crime. Moreover, the constitution of a crime founding the crime of the individuals in common crime, is identical too. |
