需补充行政行为：基于监督的制度分析

需补充和补充行政行为制度分为审批制和备案制。审批制不是放权的成果而是集权的延续和实现层级领导的方式。审批制监督功能的实现取决于相关制度的建立及其司法保障,但是审批机关难以接受监督。为此,必须按权责相一致的原则取消审批制度,即使保留审批制也应通过引入行政公开制度使审批机关接受监督、分担责任。备案制监督虽然不能在备案时制止违法行政行为的实施,但可以启动新的监督程序来纠正违法行政。

The system of administrative action needing to be supplemented consists of examine-and-approve system and register system.The system of examine-and-approve is not the result of devolution but the continuance of centralization of power and the execution of hierarchical leadership.The performance of the supervision under examine-and-approve system depends on the foundation of relevant systems and the judicial safeguard.However, it is difficult to supervise the examine-and-approve agency.So the system of examine-and-approve should be abolished according to the principle of authority with corresponding responsibility.The system of administrative openness should be brought in to put the examine-and-approve agency under supervision on condition that examine-and-approve system is reserved.Although the supervision under register system can not stop the illegal administrative action while registering,it could set out a new supervision procedure to rectify the illegal administrative action.
