社区矫正的价值定位与现实运作

社区矫正(Community Correction)作为当今世界各国刑罚执行理论和实践中发展最快的领域,已然成为刑罚执行由监禁走向开放的主要标志,其深刻的影响甚至颠覆了传统的行刑理念.顺应刑罚轻缓化、非刑化、社会化、人道化这一趋势,最高人民法院、最高人民检察院、公安部、司法部联合下发了<关于开展社区矫正试点工作的通知>,标志着社区矫正实践在我国的正式启动.制度的良性运转有赖于理论层面的深度检视,有必要从社区矫正在刑罚制度演进中的逻辑定位介入,对其在实践层面有待改善的若干基本问题进行较为深入的研究.

As one of the fast advancement categories in the theory of penalty execution and practice,community correction has been regarded as the main symbol of execution in public instead of custody.Under the circumstance of light penalty,non-penalty,socialization and humanism,the supreme criminal justice organizations has enacted "the notification of launching a pilot project of community correction",which marks the official initiate of the practice of community correction in China.Because the smooth operation of institutions lies much on the through reflection of theories,it is of great importance to find out the logical orientation of community correction in the development of penalty institutions and make a totally research on the basic problems of that in practice.
