新《民事诉讼法》图景下我国民事检察制度研究——以中美民事检察类型化分析为切入点

民事检察是检察机关参与民事诉讼活动的一项重要制度安排,几乎各国法律都有涉及,新修改的《民事诉讼法》为我国民事检察之发展注入了新血液,在这些新的变化中我们看到了以美国为代表的西方民事检察制度的元素与影子,更看到了不同文化背景下,中西方民事检察之间的互通,即我国民事检察制度正逐步向着维护公共利益的方向拓展、向着多元化的方向延伸、向着开放性的方向变化,这些正是此次新《民事诉讼法》给予我国民事检察制度最新的诠释。

Research on Chinese Civil Prosecution System under the New Civil Procedure Law in Perspective of Sino-US Civil Prosecution Type Analysis

Civil procuratorial work is an important institutional arrangement involving procuratorial organs in civil lawsuit activity that covers almost all of the countries. The newly revised Civil Procedure Law this year injects new blood into the development of Chinese civil prosecution. From these new changes, we can see the elements of Western civil prosecution system taking the United States as a representative. In addition, we also sense the exchanges between Chinese and Western civil prosecution under respective cultural background. That is to say, Chinese civil prosecution system is gradually developing toward the direction of safeguarding the pub- lic interest ; toward the direction of diversification ; toward the direction of open changes. All of the above is what the New Civil Procedure Law interprets the latest Chinese civil prosecution system.
