| 摘 要： | 个人自由与社会秩序的对立与统一始终伴随着刑法的形成与发展 ,刑法价值取向的形成有深刻的社会原因和文化根源。美国刑法的宪法限制、刑法中诸种原则和制度的设置表明 ,美国刑法的价值取向是优先追求个人自由。这种价值取向对于我国的刑事法律制度和社会观念的转变有重大的借鉴意义

| Abstract: | The contradiction and unification between personal freedom and social order are accompanied with the formation and development of criminal law, the formation of criminal law's value determination has essential social and cultural reasons. From the constitutional restriction of the American Criminal Law, to the establishment of some principles and system in the American Criminal Law, we can concluded that the value determination of the American Criminal Law is in pursuit of personal freedom preferentially. This value determination has great meaning for our system of criminal law and the change of social idea. |
