透析袭警现象背后的警察维权问题

2008年7月1日，上海市闸北区公安分局有6名警察在工作岗位上先后死于歹徒的刀下，这一事件震惊了全国，也把一系列有关袭警现象的议论推向了高潮。有的全国人大代表提出要加紧袭警罪的立法工作，以保护民警的合法权益；有的专家认为要在现有的法律条件下用好用足立法资源，不必增设新罪名等，各种意见纷呈。如何看待和分析袭警现象，似已超出了单纯的刑事立法范畴，并且与当前提出的构建和谐社会的大局相关，其中还包含着对我国民主政治制度的价值取向的态度问题。不论我们把问题提到多高的位置，袭警行为总是同警察权力或权利有着直接的关联。因此，以怎样的态度对待袭警现象，其实质在于如何正确认识警察维权的问题。

July 1,2008,six policemen of Shanghai Zhabei District Public Security Bureau have been killed by a scoundrel in the workplace.It has shocked the country,but also put the discussion of assaulting police to a climax with another series of assaulting police officers incidents.Some NPC deputies proposed to intensify the legislative work of the Crime of Assaulting Police Officers,to protect the legitimate rights and interests of civilian police;Some experts argued to make the best use of the existing legislative resources in stead of creation of new offences.How to look on the phenomenon of assaulting police officers,it seemed beyond the scope of the criminal legislation,but relating with the current situation of building a harmonious society.Even more,it is something with the value-oriented attitude to China's democratic political system.But no matter how high we put the issue of assaulting police officers with,it is always acting with the police power or right directly.So,what kind of attitude towards the phenomenon of assaulting police officers,the essence lies in how to correctly understand the issue of police's rights protection issues.
