浅析贪污贿赂罪

贪污贿赂犯罪主要侵犯国家的廉洁制度，同时侵犯公私财产的所有权关系。贪污贿赂的泛滥，不仅严重腐蚀了国家肌体和人们的灵魂，败坏了党风和社会风气，而且阻碍了国家政治、经济体制改革的顺利进行。因此，能否有效地抑制和消除贪污贿赂犯罪，直接影响着现代化建设的成败及社会的长治久安。本文拟对贪污贿赂罪的构成及本类罪与相关类罪的界限等问题作以探讨。

An Elementary Analysis of Embezzlement and Bribery Crime

In embezzlement and bribery crimes, both the honest and clean government system and the ownership of the public and private property are violated. The spread of embezzlement and bribery corrodes the state body and people' s soul, corrupts party and social values, it also hinders the development of political, economical reforms of the country. It will, therefore, impact directly the success or failure of the modernization construction and the permanent stability of the society. The article probes into the constitution of the embezzlement and bribery crime and its dividing line with other crimes.
