政府特权及其构成要件

政府特权是指政府工作人员在无法律规定的情况下或者违反法律而依照自由裁处来为公众谋福利的行动的权力,就被称为特权。政府特权的构成要件是主客观要件的统一：权利主体是政府公职人员、权利主体具有正当的目的、它存在于职务行为中、情势紧急、迫不得已及必须有良好的客观效果。

Government Privilege and Its Contributive Elements

The government privilege refers to government officials’ power to take actions for public welfare in accordance with discretion when there is a lack of legal provisions or even when the actions are going against the law.The contributive elements of government privilege are a subjective-objective unity,including the following five aspects:the subjects of right are government officials,the subjects of right have justifiable purposes,the privilege exists in official activities,government officials possess the privilege only in urgent situations and the privilege actually produces good results.
