| 摘 要： | 陷害教唆是指教唆人出于陷害他人的目的,以使他人的实行行为以未遂而告终的意思,教唆他人实行犯罪的行为。在陷害教唆中,教唆人与被教唆人并不构成共同犯罪;陷害教唆与教唆犯在主观故意和犯罪形态等方面都存在着较大差异,不能以教唆犯论处。但是陷害教唆行为具有严重的社会危害性,应当以犯罪论处。

| Abstract: | Agent provacateur is pointed to the conduct of instigating others to practice a crime for purpose of framing others with the final meaning of attempted crime.In the agent provacateur the abettor and the incited person do not constitute the joint crime ;The agent provacateur is different from the instigator in the respects of subjective intention and the criminal appearance,thus can't be treated as the instigator.But the behavior of agent provacateur has severe social harm and should be penalized. |
