| 摘 要： | 侦查程序是刑事诉讼程序中最重要的阶段，侦查权的行使不当或者滥用容易侵犯公民权利，因此如何有效地运行侦查模式理所当然地成为刑事诉讼中的重要内容。通过世界上两大侦查模式及其现状的比较和我国现行侦查模式的特点，我国应该构建一种既能制约侦查权力，避免侦查权行使的无序和恣意妄为，又能确保公民个人权利的侦查模式。

| Abstract: | Investigation procedure is an important phase in criminal law. Because it is easy to infringe people's rights when investigation action is abused, how to operate the investigation mode effectively becomes an important content in criminal law. Compared with the two great modes in the world and the characteristic of Chinese mode, we should build a mode which could not only limit the right of investigation and prevent the disorder, but also guarantee the human rights. |
