| 摘 要： | 现实生活中,人们精神世界和谐面临着危机;为实现对公民相关人格利益的充分保护,应在我国现行具体人格权体系中增设精神安宁权。精神安宁权的构建符合人本主义的价值原则,回应了缓解当前部份人群社会心理健康状态欠佳和弥补立法欠缺的现实需求,具备相当的现实基础。

| Abstract: | In practice,people's harmonious spiritual world is confronted with crisis.In order to protect the relative personality rights of the citizens sufficiently,the spiritual tranquility right should be subjoined to the present system of personality rights in China.Constructing the spiritual tranquility right is in accord with the principle of humanism.Moreover,it responses to the present need of relieving social psychological health,makes up the defaults in legislation,therefore constructing the spiritual tranquility right is in need of reality. |
