论我国责任保险立法的完善——以新《保险法》第65条为中心

我国新《保险法》对责任保险的规定存在以下不足：对保险人直接给付义务的规定相互冲突;没有就受害第三人对保险人的直接请求权进行类型化且规定的行使条件过于严格;未规定保险人的参与权;对责任保险定义存在缺陷。我国今后在修订保险法的时候应当,删除责任保险立法中相互冲突的条文;区分不同情况,在不同程度上赋予受害第三人直接请求权;赋予保险人参与权;以及完善责任保险的定义。

The Perfection of Liability Insurance Legislation

The provisions of the liability insurance in the Insurance Law of PRC still have some shortcomings as follows,i.e.,the law has a contradiction in the provisions of the liability of directly paying of the insurer,the law has too much strict criterion to the right to directly lodge a claim with the insurer for payment of indemnities,the law does not provide the participating right to insurer and there are some shortcomings in the definition of the liability insurance.The shortcomings shall be corrected in the future legislation.While modifying the Insurance Law in the future,the following corrections shall be done,i.e.,to delete the contradict provisions,authorize the direct claim right to the third parties in different degree and the participating right to insurer,and revise the definition of the liability insurance.
