| 摘 要： | 程序保障即通过法律程序的权利保障,是权利保障的一种形式。作为现代法律程序的功能和目的导向,程序保障与宪政有着共同的历史渊源,宪政的基本原理就是程序保障。公正的司法程序与司法审查程序是程序保障有效性的关键。

| Abstract: | Procedural protection, being one of the ways to protect right, means the right protection through legal procedure. As the functional and motive orientation of modern legal procedure, procedural protection shares the common origin with the constitutional government, and makes the fundamental element for it. Just judicial procedure and procedure of judicial review are keys to the validity of procedural protection. |
