论司法裁判的自明性——“彭宇案”从没有赢家到彰显政治昌明法治进步的转化

Judgment promulgation of ＂Peng Yu Case＂ causes worry of the confidence crisis and moral landslide,as well as hope of the judicial fairness,attention caused is beyond people＇s imagination.Especially the disclosure of the facts again by Nanjing official on ＂Peng Yu case＂ after four years,which causes hot debate like ＂blowout＂ once again.However,no matter how many problems ＂Peng Yu case＂ phenomenon involves,and how many reasons the specific case have had,the key problem is that the judges at the first trial had not stick to the legal standards and moral bottom line.The key to avoid similar situation lies in the judicial self definition.That is,the judge must undertake responsibility of guarding the rule of law and make the water clear,distinguishing between right and wrong,maintaining fairness and justice,and carrying forward the fine tradition of moral.
