| 摘 要： | 没收物品的处理在我国目前法律制度中没有明确规定。通过对没收物品处理中的问题和缺陷的分析,提出了没收物品处理应遵循的五项基本原则,并进一步探讨了推进《没收物品处理法》的理论研究和立法进程、建立没收与处理权分离机制、健全没收物品的处理程序和方法等三项措施。

| Abstract: | The confiscation articles handling law and regulation were not constituted.The problem and limitation during the handling procedure for confiscation articles were analysed.Moreover,5 basic principles that should be followed during the handling for confiscation articles were put forward.Furthermore,3 measures were recommended such as the promotion on theoretical study and legislation course of the confiscation articles handling law,the foundation of the separate mechansim between consfication and handling powers,the im- provement of the confiscation articles handling procedure and method. |
