Abstract: | This article analyzes relevant issues that shall be considered in a claim requiring the application of the essential facilities doctrine of antitrust law to a liquefied natural gas regasification terminal, through the analysis of a Chilean case. For this purpose, the research draws some significant lessons from the judgments of U.S. courts—which initially developed such theory—and identifies the conditions that have to be met according to the Chilean Competition Tribunal for the application of the essential facilities doctrine. |
