又美学的维度探寻法与美的情缘

人类社会文明的高层境界是法律与美育的交融互摄。美和法均追求"真"和"善"的永恒价值,美学和法学所遵从的都是美的本质。法虽然表面上丧失了令人愉悦的直观趣味,实质上却隐蔽了法学所内蕴"真"与"善"的美学价值。从"美"的特征与"法"的属性探究二者内在关系发现,和谐与秩序构成法学与美学的共同交会点。法美学作为一种审美意识的高级操练,是"美"为"法"体现美的内在价值,司法的价值在于最终实现和谐的美。

The Exploration of Relationship between Law and Beauty from the Aesthetic Dimension

The highest level of human civilization should be the harmonious combination of Law and Aesthetic Education. The reason why the law and the Aesthetic Education, even though belong to totally different strands, can be compared, is that both of them are pursing "the True" and "the Good". Representing as a tool and a skill respectively, the Law and The Aesthetics both follow the same route, the Beauty. On surface of it, the Law has lost its interesting and pleasant character; in fact, it has the aesthetical value of both "the True" and "the Good" inside. We would find that the harmony and orderliness are the confluence of the Law and the Aesthetics if we explore the internal relationship from the perspective of the characteristics of Beauty as well as the attribute of the Law. The Aesthetic Education of Law should be regarded as a practice for our aesthetical consciousness. The ultimate goal of beauty is for the Law and the deep value for judiciary is for realizing harmonious beauty.
