危险犯概念的再研究

关于危险犯的概念 ,无论是在大陆法系 ,还是在我国 ,都存在许多争议。本文通过对中外刑法理论中危险犯概念的研究 ,从危险犯的特征入手 ,对“危险犯”作了重新界定 :行为人故意或过失地实施一行为 ,当该行为的发展趋势脱离行为人的控制 ,以致使受刑法保护的公共安全、人身财产安全和社会秩序等社会关系出现法定的具体危险状态 ,但实害结果尚未发生即构成犯罪既遂的犯罪。

Studies on the Concept of Dangerous Criminals

Having studied the concepts of dangerous criminals in foreign and Chinese criminal law theories, the author provides a new definition of dangerous criminals from the characters of criminals. A crime, conducted with intention or by mistake ,when it has developed beyond offender's control and made the social relations such as public security ,property security in an extremely dangerous state, is regarded as the accomplished state of crime.
