地方民主与公民参政的法定化制度化

我国宪法和法律规定了人民行使国家权力的基本形式,但长期以来,有关这方面的立法比较滞后;现实生活中,公民行使民主权特别是直接民主权缺乏法律保障,参政形式比较单一。按照党的“十六大”提出的“丰富民主形式”的要求,应研究实行地方民主,特别是直接民主的有益形式,建立健全地方民主和公民参政的法律机制。

Legalization and Institutionalization of Local Direct Democracy and Citizen's Political Participation

Local direct democracy is not only an integral part of pluralistic democracy, but also an important part of the political system reform in China. Since the reform and opening up to the world, China has placed the local democracy and citizen's political participation on the agenda though it will be a long-term strategic task in China. According to the principles and stipulations of the Constitution and Law, China shall strengthen the legislation relating to the local democracy and citizen's political participation. The amendment to Constitution and the relating laws shall include some forms of local direct democracy.
