| 摘 要： | 以自发秩序和私法为基石的私法模式是理想主义的,而以政府的制度导向和公法为基石的公法模式却是现实主义的。私法模式是完美的,但在实践中难以成功；公法模式是简陋的,但更为实用和有效率。

| Abstract: | On the base of spontaneous order and private law,the mode of private is idealism.But pub- lic law mode basing on governmental function and public law is realism.Although private mode is perfect,we have many difficulties in putting it into practice.Public mode is simple,but we will choose it. |
