中国废除死刑的路径选择

废止死刑通常有四条路径:宪法路径、立法路径、司法路径与联合路径。诸条路径各有优劣短长,立足联合路径,汲取其他路径之长,可以设计出中国废除死刑的一种综合路径,即:立法上削减与废止和司法上限制与搁置互相配合,司法上限制和搁置先行,立法上逐步削减与废止跟进,最终在立法上和司法中完全废除死刑。综合路径可以分四步走。综合路径的畅通还需有相关制度的完善,以及政治家、立法者、法官、民众和学者等的广泛参与和支持。
