| 摘 要： | 在刑事诉讼中,举证权利是与举证责任相伴生的,目前的刑事诉讼理论与实践都强调了举证责任,而未论及举证权利。举证权利属于控诉权、辩护权、审判权中的内容。在我国刑事诉讼法律规范中,应建立完备的举证权的制度。

| Abstract: | In a criminal lawsuit,rights of producing proof are accompanied by burden of proof,while pre sent theory and practice of crim inal lawsuit only lay stress on burden of proof and neglect to discuss on rights of producing proof.This paper discusses that rights of producing proof belong to the contents of accusatory rights,defence rights and trial power and it's necessary to establish and perfect the system of the rights of producing proof in the legal norms of our criminal lawsuits. |
