| 摘 要： | 行政解释近年来开始受到关注,研究的视角在逐渐的开阔,取得了一定的成果。但是,行政解释的研究始终在做着现行法律规定的注脚,几乎是纯粹地进行着固守法律文本的解释,这与法律解释的发展趋势和依法行政的现实需要极不相符。行政解释应该在行政解释主体、对象与司法审查方面实现回归与创造,行政解释的再定位已经不容忽视。
