| 摘 要： | 《刑法修正案》（七）草案第11条新增了贿赂犯罪的内容，这有助于严密抗制贿赂犯罪的刑事法网。但是，就新增条文贿赂犯罪内容的罪名确认，存在着不同的看法。在充分分析贿赂新增条文罪名确定的争议后，我们认为，宜增设影响力交易罪来全面规制间接受贿行为，在此基础上，提出了增设影响力交易罪的具体路径。
