| 摘 要： | 在大学校园这样一个特殊的小社会、大世界中，大学生以受教育权被侵犯诉母校的不当惩戒纠纷在不断地上演着，文章分析了高校惩戒权和大学生受教育权冲突的原因，试图以最大限度的保护学生受教育权为考量基点，着重规范处于强势地位的高校惩戒权，以期达到二者之间的平衡。
