宪政视角下的“公民上书”

在推进我国宪政建设的进程中,近年来,"公民上书"事件的涌现成为一个令人瞩目的亮点."公民上书"对于推进权力对权力的制约和权利对权力的制约都具有相当作用,具有积极的宪政意义.未来可以借鉴国外违宪审查的某些做法,针对我国现行的违宪审查的不足加以改进,设立宪法委员会,让"公民上书"的范围扩大,能得到及时回应以及特殊情形能以听证形式进行,让"公民上书"在宪政的推进上发挥更大的作用.

Cilvil Appeal From the Angle of Constitutionalism

The emergence of civil appeal has been highlighted in recent years during the course of constitutionalism construction. It is important and positive for civil appeal to advance the restrictions of power to power and right to power. In future, it can be adopted some ways of examination of breaking constitution in foreign countries and constitution committee could be set up in the light of some weak points existing in the examination of breaking constitution in our country, and the range of civil appeal would be enlarged, responded in time and some special cases could be conducted in the form of hearing, therefore, the civil appeal could play a bigger role in promoting the constitutionalism.
