"信仰之力量"的光与影——教会法人财产制的历史功用及其启示

基督教之社团财产法,在调和教会信仰的"纯洁性"与教会支配财产的"世俗性"之间矛盾的过程中,形成了独特的技术结构——教会目的财产说——相对于法人实体说与法人拟制说而言,是法人制度实践的进一步深入。但用于维持教会财产目的性的主要机制——信仰的力量——本身的不可靠,致使教会财产制在短暂成为"反封建"的革新力量以后,很快站到历史发展的对立面。这说明昭示法人制度未来的"目的财产说"还只是一种有益的"理想",以单纯的"信仰"为保障目的的实现,将导致对法人管理人做"性善论"假设,最终是善恶混淆的"自然状态"的复萌,这对以信仰立国的我国尤有警示意义。

When adjusting the conflict between pure religious and humanity property control,the community property law of church has consisted its unique technical construct-theory of purpose-aiming property which is a grate development regarding to the practice of legal person system comparing to the theory of entity and proposing on legal person.However,for the disadvantage of belief on which church property has relied,the theory of purpose-aiming property has obstructed the social development and the church property has been suspended during the following social revolution.It is suggested that theory of purpose-aiming property is only a positive "belief" for legal person practice.The method consisted of simple "belief" will result the assumption of "person in good faith" on the manager of enterprise.All of these will act as a special warn for China which founded itself on belief.
