法律全球化新论——从辩证与历史唯物主义的视觉

在经济全球化成为时代主旋律的背景下,西方学者形形色色的法律全球化理论纷涌而上,并引发包括中国在内的广大发展中国家的学者广泛思考。事实上,无论是在东西方,法律全球化皆是一个全新课题,它的内涵是否具备科学性;它是否是已存在事实或客观发展趋势;它是否是经济全球化的必然要求或反映以及其与国家主权之间是此消彼长还是辩证统一关系等等,都是很值得研究的问题。本文正立足于此,拟从马克思主义唯物辩证法与唯物史观的角度,对这些问题作出探讨,以求得抛砖引玉之效。

A New Study of the Legal Globalization

In the era when the economic globalization becomes the mainstream,various schools of theories involving legal globalization in western countries turn up,which attracts a widespread observation worldwide including the legal scholars in the third world.The thesis based on Marxist materialistic dialectics and Marxist materialist conception of his- tory deals with the above-mentioned problem for the purpose of launching some superior theories.
