| 摘 要： | 精神损害是一种无形的损害 ;精神损害赔偿制度近年来在国际上发展迅速 ,在我国 ,它是一项民事法律制度 ;由于对它的“民事法律制度”的定性 ,致使其在我国的发展仅局限于民事领域。本文在介绍损害赔偿制度的国内外发展的基础上 ,郑重论证了在刑事和行政领域建立该制度的现实性、可能性和必要性

| Abstract: | Mental damage is an invisible damage. During these years, the compensation system for mental damages is rapidly developed abroad. It is a civil law system established in our country. Its determination "Civil law system" makes its development in our country limit in the field of civil affairs. On the basis of introducing the development of compensation system domestically and abroad, this thesis emphasizes on demonstrating feasibility, possibility and necessity of the establishment this system in the field of criminal and administration. |
