司法解释与立法的耦合：中国国际私法和谐发展的时代要求

司法解释在理论上与立法同属中国国际私法的法源,从制度设计上讲,两者本应处于互动与耦合状态,然而,长期以来,部分司法解释超越立法已是不争的事实,本文拟就导致部分涉及国际私法内容的司法解释与现行立法"脱耦"这一现象的内在原因作一学理分析,提出若干值得反思的问题,并就促进两者的耦合,进而推动中国国际私法的和谐发展提出若干建议,

Coupling of Judicial Interpretation and Legislation: Times Demands upon Harmonious Development of China''''s Private International Law

Theoretically speaking, judicial interpretations and legislation equally belong to sources of China's private international law. In point of institutional design, they should be coupled with each other. However, for a long time ,there is no doubt that some judicial interpretations overstep the scope of legislation. This thesis tries to analyse the internal causes of this mismatching phenomenon, and discuss how to promote the harmonious development of China's private international law.
