| 摘 要： | 精神损害赔偿制度是衡量一国民主法治进程的重要尺度。建立国家侵权精神损害赔偿制度不仅是现实需要,也是法理使然。本文以法哲学的视角从精神利益可物化性、人性发展、人权保护、法制统一、公平原则等方面对国家侵权精神损害赔偿制度进行探讨。
