论“一事不再理”原则在票据诉讼中的适用

"一事不再理"原则是一项获得大陆法系及受大陆法系影响的国家广泛认同的诉讼原则。在我国,该原则虽然没有在《民事诉讼法》中明确规定,但在我国民事诉讼法理论和实践中广泛采用。然而,由于人们对"一事"的理解并不一致,因而也就导致在具体适用该项原则过程中充满着矛盾。文章以票据诉讼为视角,对"一事不再理"原则在票据诉讼中的具体适用问题,进行比较深入地分析研究,并以诉讼标的理论为基础,对"一事不再理"原则在票据诉讼适用过程中发生的争议问题,提出了自己粗浅的认识,以期对票据诉讼理论和实践有所裨益。

On Application of Non Bis in Idem to Action of Commercial Paper

Non bis in idem,as an action principle,is world widely accepted by the countries of continental law system and the countries affected by continental law system.In our country,the principle is not explicitly indicated in civil procedure law,but it has been widely applied to the area of the theory and practice of civil procedure in our country.Because people differ on the understanding of the same cause,however,there are full of inconsistencies in application of the principle.The paper makes a deeper analyse on application of non bis in idem to action of commercial paper from the angle of action of commercial paper and puts forward my view on inconsistencies arising in application of non bis in idem to action of commercial paper on the base of the theory of subject matter,hoping to be helpful to theory and practice of action of commercial paper.
