| 摘 要： | 近年来,随着诉讼实践的发展,辩诉交易的借鉴成为我国法学界以及司法部门越来越关心的问题,讨论较多的是如何借鉴和适用辩诉交易。而辩诉交易的关键是控辩双方达成协议,被告人作出有罪答辩,即被告人自认其罪。在这一过程中,涉及到被告人的诉讼权利问题,本文对辩诉交易下的被告人权利问题作了探讨。

| Abstract: | In recent years, use of plea bargaining for reference become the main concern for the legal science and judicial departments . The focus is how to refer to and put to use the plea bargaining. The key for a plea bargaining is an agreement between the prosecution and defence and that the defendant gives a guilty answer, that is, he admits his guilt, which has to do with the defendant' s right of litigation. This paper is just about the right of the defendant in a plea bargaining. |
