海牙《扶养义务法律适用议定书》新规则探究

涉外扶养是当今国际社会民事领域的热点问题，我国已签署的于2007年11月通过的海牙《扶养义务法律适用议定书》，是海牙国际私法会议最新的有关涉外扶养法律适用的国际条约。文章通过深入研究该议定书的新规则，探求其优势所在及存在的缺陷，以期得到国内学界的关注。

Research on the New Rules of the Hague Protocol on the Law Applicable to Maintenance Obligations

Maintenance across the frontiers is a hot spot of current international civil domain. The Protocol on the Law Applicable to Maintenance Obligations, passed on November 2007, is the most recent international convention drafted by Hague Conference on Private International Law about the law application to maintenance obligation across the border. China signed it last year. This paper makes a comprehensive survey and study on the new regulation of the Protocol, and tries to pursue its advantage and disadvantage in the hope for filling the gap which exists in the aforementioned research field in China.
