摘    要:劳动用工制度的变化导致新类型劳动合同纠纷增多,《劳动法》对其的调整已力不从心。对于劳动合同与雇佣合同的区别、劳动合同的单方解除、劳动合同的履行问题,我国现行法律、法规未规定或者规定并不明确,故此,学术界及司法界对此作深入探讨的意义重大。

Abstract:With disputes on the contract of labor increasing, Labor law could not deal with them completely. As to the contracts distinction, cancelation and fulfillment, our law has no clear stipulation. Therefore, it is of great significance for the academic and judicial circles to take a probe into the issue.
