论制约贿赂犯罪初查工作模式转型的三个因素

新修改的刑事诉讼法、《人民检察院刑事诉讼规则(试行)》等法律法规、司法解释的颁布实施使得现阶段初查工作模式面临转型。但转型过程并不是一帆风顺的,特别是贿赂犯罪初查工作模式的转型,当中面临的制约因素需要结合实践进行分析归纳,这些制约因素主要包括案件办理过程中形成的线索倒逼机制、公职人员隐私范围认定的不明确以及初查周期评估的缺位。

Three Constraints in the Transformation of the Preliminary Investigation Mode of Bribery Crime

The promulgation and implementation of the newly revised “Criminal Procedure Law”, “People＇s Procuratorate Rules of Criminal Procedure （Trial）”, some other laws, regulations, and judicial interpretations are impelling the transformation of the current preliminary investigation mode. However. the transformation doesn＇ t go smoothly, especially in the transformation of the preliminary investigation mode of bribery crime. So, many constraints in the transformation need to be conclusively analyzed, mainly including the forced mechanism of clues inquiry in process of dealing with cases, unclear privacy scope of public officials and the absence of the assessment of the preliminary investigation cycle.
