海峡两岸《综合性经济合作协议》的法理思考

《综合性经济合作协议》（Comprehensive Economic Cooperation Agreement，简称CECA），是海峡两岸正在协商的一项综合性经济合作协议。虽然海峡两岸都希望能尽快签署该协议，但因各方对待该协议的态度和目的不完全相同，使得协议的法律性质、签署方式和内容成为极其敏感的问题。为避免协议被国际化，我国大陆应该坚持“一国两制”的基本方针，同时，在协议内容上坚持两岸在经济利益上互利共赢的原则，借鉴中国内地与香港地区在2003年达成的《内地与香港关于建立更紧密经贸关系的安排》（CEPA）的有关经验，使CECA切实为两岸的融合与经贸繁荣发挥作用。

Jurisprudential Thoughts about the "Comprehensive Economic Cooperation Agreement" Between the Two Sides of Taiwan Strait

The two sides of Taiwan Strait are consulting on the ＂Comprehensive Economic Coop- eration Agreement＂ （CECA）. Both sides want to sign this agreement as quickly as possible, but the two sides don＇t keep the same attitude and purpose. As a result, it makes the following issues be- came sensitive problems： the content and legal nature of the agreement,the method to sign the agree- ment. In case the agreement would be internationalization, the Mainland should stick to the princi- ple of ＂One country, two systems＂ ; in additional, the content of the agreement should benefit both sides. In order to ensure that CECA can make substantial contributions to the syncretic and econom- ic prosperity of two sides of Taiwan strait, it＇s also important to learn from experiences of the ＂Main- land/Hong Kong closer economic partnership arrangements＂ （CEPA） which was reached between Mainland and Hong Kong at 2003.
