行政紧急权的理性探析

行政紧急权力是一种在紧急状态下受必要的民主宪政的分权制约和人权保障原则实质性制约,由行政机关集中行使的国家权力,其目的即为了应对紧急情况对国家正常秩序的威胁和侵害,以尽快地恢复正常统治秩序及实现保障人民权利的最终目标.在紧急状态下赋予政府集中扩张的紧急权力,即在于通过该权力的行使,克服现代民主宪政制度的缺乏效率的局限性,尽快地恢复正常的社会秩序.但是必须在宪政框架下对这种强化的行政权严格加以规制,对行政机关紧急权力给予必要的制约与监督,包括权力机关之间的权力制约以及人民权利对权力的制约,防止行政紧急处置权的滥用和独裁.

Theoretical Analysis of the Administrative Emergency Power

The administrative emergency power is a kind of National Power,which is necessarily restricted by the constitutionalism principle of check and balance and principle of human rights protection,and central exercised by government.Its aim is to pass the crises and resume the normal order and avoid the threat and invasion to the human rights by the emergency station.It's necessary to conquer the inefficiency of the modern constitutional democracy and to resume the normal order through the exertion of the central and expanded power.But,must be strictly and necessarily restricted and supervised,including the restriction and supervision of the authority and the human right,to avoid the abuse and despotism of the administrative emergency power.
