Terrorist Attacks

Abstract:This paper reflects upon the USA’s war against terror and how it has been reflected in recent attempts to change German law. The author highlights the differences between war and crime, between police law and ius belli and pleads that this differentiation be respected in the formulation of policy. He charts the recent debate about the role of the armed forces in Germany especially in relation to potential missions within the country, particularly in accordance with the aviation protection act, which was found to breach the constitution. The paper highlights the issues as to why this was the case and ends with an account of the anti-terrorist measures undertaken by the EU.
