浅议《中华人民共和国村民委员会组织法》的立法修正

自《中华人民共和国村民委员会组织法》公布实施以来,我国的农村村民自治开始进入法律依据明确、制度配套相对完善的稳步运行阶段。但我们在认识到该法的积极作用的同时,也应对其进行较为公允的立法评价,并提出修改、完善的意见。文章从处理好六对关系入手,从保障村委会成员的合法合理当选;村委会科学民主决策;权利救济渠道的畅通三个方面,透过实体和程序两个视角对该法提出了若干立法修改与补充建议。

On Legislative Amendment of the" Law of Organization of Villager Committee of the P. R. of China"

Since the "Law of Organization of Villager Committee of the Peoples' Republic of China"was promulgated and implemented, the self-governance among villagers of China has begun entering steadily a period with a clear legal basis and perfect system. But at the time we are aware of its positive roles, we should also make a fair and just legislative appraisal on it and put forward amendment ideas. The paper brings forward some legislative amendment and supplementary suggestions from three aspects. The first one is to guarantee the members of villager committee to be elected legally and rationally.The second one is villager committees should make decision scientifically and democratically. The last one is to provide the smooth ways of legal relief.
