论刑法立法解释

刑法立法解释应当限于以全国人大常委会名义颁布的专门解释,它应当与刑法草案说明、刑法解释性条文、立法解释性文件、立法解释性意见相区别。刑法立法解释的对象限于刑法的重要原则、基本概念和检、法两家在某些问题上形成分歧不能达成共识的情形,它作为刑法改进与刑法司法解释的中间物,其独特价值在于明确概念、澄清争议、统一司法。从完善的立场看,该种解释应注意必要、及时和规范三个方面。

On Legislative Interpretation of Criminal Law

Legislative interpretations of criminal law must be c onfined to special interpretations promulgated in the name of the Standing Commi ttee of the National People' s Congress and be distinguished from the explanatio ns of the draft of criminal law,interpretative arti-cles of criminal law,docume nts of legislative interpretation,and suggestions of legislative interpretation. Legislative interpretations of criminal law must be important principles of crim inal law,basic concepts and differences between the Supreme People' s Court and the Supreme People' s Procuratorate.The unique value of legislative interpretati on lies in its function to define concepts,settle disputes and seek unity of jus tice.Moreover,legislative interpretation should be necessary,opportune and stand ardized.
